The general conditions of sale apply to all reservations and transactions with Colette Hôtel.
A. BOOKING AND CANCELLATION CONDITIONS
"Reservation Guarantee
Reservations must be guaranteed at the time of booking by one of the following means: Credit Card / Debit Card / Bank Transfer / or Cash.
Depending on the specific conditions of the reserved rates, a deposit of up to 100% of the reservation amount may be charged at the time of booking. (Refer to the specific reservation rate conditions).
Providing a credit card number commits the customer to the hotelier and implies acceptance of the sales conditions.
In accordance with the "Informatique et Libertés" law of January 6, 1978, the information concerning you will remain accessible and modifiable.
Hotel Le Lotus will proceed with a pre-authorization of the credit card before the arrival date.
Cancellation Policy
If you need to cancel, please inform us in a timely manner, respecting the cancellation deadlines.
Cancellation conditions depend on the reserved rate, see the specific reservation conditions.
For reservations of more than 3 rooms, specific deposit and cancellation conditions will apply.
The deadlines are counted from the client's arrival date.
Reservations of less than 3 rooms:
For a flexible rate, you can cancel your reservation of less than 3 rooms free of charge up to 24 hours before your arrival day. After this period, the amount of the first night will be charged, the deposit will be retained by the Hotel, and an invoice will be sent to you.
For all other non-flexible reservation cases, the cancellation conditions will be provided upon confirmation.
If you have booked a special offer, your reservation is non-cancellable and non-refundable. However, you can contact us to see if we can modify the dates up to 72 hours before the scheduled arrival. Additional charges may apply based on the desired dates.
The deadlines are counted from the client's arrival day.
Reservations of more than 3 rooms:
For any group reservation of 3 or more rooms based on a flexible offer, the free cancellation period is as follows:
- 72 hours for fewer than 3 rooms,
- one week for 3 to 5 rooms,
- two weeks for 5 to 10 canceled rooms,
- one month for 10 to 15 canceled rooms.
- two months for more than 15 canceled rooms; however, the deposit will not be refunded.
For any group with more than 10 rooms, a 30% deposit of the stay will be required upon reservation and will not be refunded, 50% of the reservation amount one month before, and the remaining 20% will be required on the day of arrival at the latest.
Please note that breakfast for a group can only be taken according to a schedule of approximately 10 people at the same time to allow other guests to have their breakfast and to provide better service.
Room Availability
The allocation of specific rooms cannot be guaranteed. The reserved rooms are available to the client from 3:00 pm on the day of arrival. The rooms must be vacated by 11:30 am at the latest on the day of departure.
Please inform the hotel if you plan to arrive before 3:00 pm or after 11:00 pm. After 11:00 pm, without any communication from you, the hotel reserves the right to release your room if your reservation is not guaranteed.
Only adults are allowed to rent a room; any minor must be under the supervision of a responsible adult present throughout the stay. No minor can stay or move alone within the hotel.
The hotel is a completely non-smoking area, even with windows open. A designated smoking area is provided in the courtyard. The customer will be held responsible for direct and/or indirect, consequential damages resulting from smoking and vaping in the hotel. Therefore, the customer will be liable for the full amount of cleaning and restoration costs for the damaged item or space.
The general prohibition of smoking in hotels and restaurants has been in effect in France since January 2, 2008, for all public places, including hotels that specifically indicate they are entirely non-smoking.
Any violator is subject to a penalty of €500, which will be directly charged to the credit card provided as a guarantee (loss of revenue due to the impossibility for the hotelier to re-rent the room for several nights following the departure of the smoking guest / mandatory cleaning of all fabrics/carpet shampooing/washing of walls, curtains).
For safety reasons and respect for everyone, smoking is strictly prohibited throughout the hotel. In accordance with Decree No. 2006-1386 of November 15, 2006, which sets the conditions for implementing the smoking ban in places used collectively, smoking in the hotel may result in additional charges or legal action.
Any inadvertent triggering of the fire alarm due to non-compliance with this provision will incur a €150 charge for reactivating the fire safety system.
The client is responsible for all damages caused by themselves or any person for whom they have booked a stay in the hotel and agrees to bear the cost of restoring said premises in the event of damage.
Noise, even during the day, is prohibited. Any client causing disorder or scandal in any form will be asked to leave the hotel immediately without a refund for their stay. To ensure the tranquility of the establishment, all noise must cease between 10 pm and 7 am. Please respect the rest of other guests by closing your doors quietly, making phone calls in your room and not in the hallway, and being considerate by avoiding noise, especially between 10:00 pm and 8:00 am. Any noise disturbance caused by a person under their responsibility may lead the hotelier to ask the client to leave the establishment without the need for acoustic measurements, as long as the generated noise is likely to disturb other guests (Art. R.1334-30 and R.1334-31 of the French Public Health Code). The cost of compensating guests affected by the noise disturbance will be charged to the credit card of the noisy guests. A hotel room is a place of rest. Any commercial activity is strictly prohibited.
For the same reasons, visits can take place in the lounge or bar but not in the rooms. Please do not exceed the maximum number of people allowed in your room for safety reasons.
Rates
Rates are quoted in Euros and include VAT, unless otherwise specified at the time of booking.
The rates are per room for the number of persons indicated and for the selected period.
Prices mentioned on the website and at the reception are subject to change at any time by the hotel without prior information or notice. Only the price indicated in the booking confirmation by the Company is contractual.
Rate changes will not be applied to already recorded reservations, except in the case of changes in legal taxes.
The prices mentioned include only the services strictly mentioned in the reservation. Additional services provided by the hotelier during the stay and, if applicable, the tourist tax, will be added to the price mentioned in the reservation.
Depending on the chosen offer, breakfast will be an additional charge if you have not selected the "Breakfast Included" or "Half-board" package.
The Tourist Tax per day per person is due for any client over 18 years of age, following the recommendations below, amount, exemption...
No stay reserved before the implementation of any promotional offer will be eligible for a refund, even partially."
B - PAYMENT METHODS
### Guarantee
All reservations require a guarantee or a deposit. Guaranteed reservations are held until 12:00 pm on the day following the scheduled arrival date. Upon arrival, the Hotel will request the Client to provide a security deposit or authorize the debit of their credit card to guarantee payment for the services consumed on-site.
The Client will then provide their banking details, including the name of the credit card, the credit card number, the expiration date (the credit card must be valid until the end of the stay), and the security code.
The Client will be asked to present identification as part of the procedures to prevent credit card fraud, along with the card used for the reservation.
a - Credit Card: A valid credit card under the name of the client must be presented upon arrival, along with identification. A pre-authorization for the total amount of the reservation will be taken upon arrival. The hotel reserves the right to take any necessary additional pre-authorizations.
b - Debit Card: A valid debit card under the name of the client must be presented upon arrival, along with identification. The payment for the total amount of the reservation will be processed upon arrival. The payment for all additional expenses must be made before departure.
c - Cash: The payment for the total amount of the reservation will be made upon arrival. The payment for all additional expenses must be made before departure.
d - Bank Transfer: The transfer must be received in the bank account 24 hours before arrival. A credit or debit card will be requested upon arrival to cover additional expenses, along with an identification card. A pre-authorization will be made.
Accepted Payments: Cash, Vacation Checks, American Express, Visa, Euro/Mastercard, Carte Bleue, Bank Transfer, JCB.
For companies, we offer agreements with the possibility of deferred payment by check or bank transfer.
Default of Payment: In case of non-payment on the contractual due date, late payment penalties will be due from the day following the invoice due date at a rate of 15% per annum, applied to the total VAT-inclusive amount of the invoice. Additionally, a flat-rate indemnity of €40 excl. VAT per claim will be due from the day following the invoice due date, to which will be added an additional indemnity to cover all costs incurred in the event of contentious recovery. It is reminded that any payment beyond 60 days from the invoice issuance date is legally considered an abusive practice and is subject to penal sanctions. Furthermore, any default of payment on the contractual due date will make immediately due all remaining debts owed by the Client under invoices issued by the Hotel, and will result in a change of payment terms, meaning the Client must prepay any new reservation request until the total payment of debts owed to the Hotel.
C - EXTRAS
All extras (telephone, bar, breakfast, etc.) must be paid for on site before departure. Hôtel Le Lotus reserves the right to pre-authorize your credit card to cover these charges. In the absence of payment for these services, these sums will be debited directly.
Wifi is free and unlimited in the hotel.
D - INSURANCE
The hotel will be released from all obligations in the event of a force majeure or fortuitous event (strike, fire, water damage, pandemic).
E - COMPLAINTS
Any dispute or claim must be sent to the hotel by registered letter with acknowledgement of receipt within a maximum of 8 days after the customer's departure.
After this deadline, no claim will be accepted.
Any luggage left in our establishment without prior information and request to our reception will only be kept for 24 hours and invoiced.
F - FORCE MAJEURE
The Parties shall not be held liable if the non-performance or delay in performance of any of their obligations as described herein is due to force majeure, as defined in article 1218 of the French Civil Code.
G - LIMITATIONS OF LIABILITY
The total liability of "Hotel Le Lotus" for any loss shall not exceed the amount paid by you to the hotel as part of your booking at the time the loss occurs. We shall not be liable for (1) any loss not caused by breach of contract, breach of statutory duty or negligence, (2) any indirect or consequential loss, or (3) any loss caused by you or any member of your party.Nothing in these terms shall limit or exclude the Hotel's liability for fraud or death or personal injury or any other matter which we cannot limit or exclude by law. The Hotel reserves the right to cancel any event if it reasonably considers that it may damage its reputation and, in such event, no refund will be given.You are responsible for your own conduct and that of your guests and must not at any time cause a breach of the Hotel's policies or any applicable law or cause a nuisance to other Hotel guests. You must reimburse the hotel in full for any loss or damage caused to the hotel or any interruption of our operations by your acts and omissions or those of members of your party, whether through negligence or we reserve the right to charge your credit or debit card for such amounts.
I - VARIOUS
These terms and conditions may be updated or modified from time to time and will be fully applicable after publication on the site. If these terms and conditions are changed after you have made a reservation and affect your relationship with the hotel in terms of taxes or other changes arising from local laws, you will be notified by email to the address you provided during the registration process.
